As more couples choose to get married or enter into second marriages, it is often advantageous to one or both parties to enter into an agreement to set out the terms for division of assets if the marriage should end. A prenuptial agreement entered into prior to marriage or a postnuptial agreement prepared after being married can provide clarity and assurance to both parties.

The prenuptial agreement typically covers three subject areas:

• Whether or not pre-marital separate property will remain separate properly after the marriage
• Whether or not earnings during the marriage will be community or separate property
• Whether or not the parties wish to waive spousal support in the event of a marital dissolution

The postnuptial agreement can deal with these three factors and others.
