The last general area in
divorce proceedings concerning which we typically assist our
clients is requesting and obtaining court order(s) that the other
party pay part and/or all of our client's attorney fees and/or
court costs. There are several code sections an extensive number
of appellate decisions which provide the basis for the court to
order one party to pay part and/or all of the other party's
attorney fees. Be aware, however, that the vast majority of said
sections make such an order discretionary with the court; i.e.
while one can request attorney's fees, the court may or may not
grant such a request.
